Terms of service
The rules for using TaskLyft, operated by Elementary Creative Inc.
Who these terms cover
These terms apply to the TaskLyft website, mobile apps, public booking pages, invoices, and related services operated by Elementary Creative Inc. (the "Service Provider"). Together these are the "Application".
By creating an account, signing in, or using TaskLyft, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Application.
Eligibility
You must be legally allowed to use TaskLyft in your jurisdiction. You must be at least 16 years of age, or the age of digital consent where you live if it is higher. If you are under 16, a parent or legal guardian must review and accept these Terms on your behalf.
License to use TaskLyft
Subject to these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application for your personal use or your internal business operations.
You may not copy, distribute, modify, create derivative works from, reverse engineer, decompile, or disassemble the Application, except where applicable law expressly allows it. You may not remove or hide copyright, trademark, or other notices in the Application.
Intellectual property
Elementary Creative Inc. owns TaskLyft, including its code, design, trademarks, logos, and branding. These Terms do not give you a license to use TaskLyft marks or branding for any other purpose.
You keep the rights in the content you and your shop add to TaskLyft, such as customer records, job notes, photos, and invoices. You grant the Service Provider a non-exclusive, worldwide, royalty-free license to host, store, display, and process that content only as needed to run the Application. We do not sell that content or sublicense it apart from providing TaskLyft.
Accounts, shops, and customer data
You are responsible for your login, your devices, and activity under your account. Keep passwords confidential and tell us if you think the account is compromised.
If you run a shop on TaskLyft, you are responsible for the customer, appointment, invoice, and team data you store. You must have a lawful basis to collect that information and to send emails or SMS on your shop's behalf. Customers should contact the shop first about their booking or invoice records.
You represent that you own or control the rights in content you submit, and that using it in TaskLyft does not violate the law or someone else's rights. Do not add another person's personal information without their consent.
Acceptable use
You agree not to use TaskLyft to post, store, or send content that:
- Is illegal or infringes someone else's intellectual property
- Is abusive, threatening, harassing, defamatory, or hate speech
- Incites violence or illegal activity
- Is spam, phishing, or malware
- Violates someone else's privacy
- Is false or deceptive in a way that could harm others
- Contains explicit sexual content or graphic violence
You also agree not to probe, disrupt, or overload the service, bypass security, or use TaskLyft to compete with it by scraping or copying the product.
Reports and moderation
If you believe content or an account violates these Terms, email contact@elementarycreative.com with enough detail for us to find the content and contact you. We may remove or restrict content, suspend or close accounts, and work with law enforcement when required.
If we take action that affects your account, you may ask for a review at the same address. We will respond within a reasonable time and, where the law requires it, explain the decision.
Fees, payments, and third-party services
Some TaskLyft features may be paid. We will tell you the price before you are charged. Card payments and payouts are processed by Stripe. Stripe's terms also apply to those payments.
Shops are responsible for taxes, refunds, and the accuracy of invoices they send. TaskLyft is software for running a shop. It is not a party to the services a shop sells to its customers, except where we process a payment as described at checkout.
Internet, devices, and updates
TaskLyft needs an internet connection. Your mobile or internet provider's charges, including roaming, are your responsibility. Keep your device charged and reasonably secure. Jailbreaking or rooting a device can break the app and weaken security.
We may update the Application. You should install updates when offered. We do not promise that every older operating system will stay supported. If you skip updates, some features may stop working.
Changes to the service
We may change or discontinue features. If we charge for a service that was free, or change a paid plan, we will tell you first. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.
Limitation of liability
To the fullest extent permitted by law, the Service Provider is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if we were told those damages were possible.
We remain fully liable for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, and for any liability that the law does not allow us to limit.
To the fullest extent permitted by law, our total liability for a claim is limited to the amount you paid us for TaskLyft in the 12 months before the claim, or the minimum amount the law requires, whichever is greater. If you used TaskLyft free of charge, liability is limited to the minimum the law allows.
We are not responsible for loss caused by relying on information that a shop, customer, or other third party entered into TaskLyft.
Indemnification
To the fullest extent permitted by law, you agree to indemnify the Service Provider and its officers, employees, and agents against claims, damages, and reasonable legal fees that arise directly from your breach of these Terms or your intentional misuse of the Application, including content you submit in violation of these Terms.
This does not apply to claims caused by our own negligence, our breach of these Terms, or our violation of the law. Where consumer law limits indemnification, this clause applies only to the extent allowed.
Suspension and termination
If you materially breach these Terms, we may suspend access and give written notice. Where the breach can be fixed, you will have 14 days from that notice to fix it. If you do not, we may close your access.
We may suspend or terminate immediately, without notice, if you break the law, infringe intellectual property, or do something that could harm other users or the Service Provider.
We may also stop offering TaskLyft. Unless we say otherwise, your license then ends and you must stop using the Application and delete copies from your devices. Some records may be kept as described in the Privacy Policy.
Governing law
These Terms are governed by the laws of the jurisdiction where Elementary Creative Inc. is established, without regard to conflict-of-law rules, except where mandatory consumer protection laws say otherwise.
Disputes will be brought in the courts that have jurisdiction under applicable law. This does not limit any right you have to sue in a court that mandatory law makes available to you.
Digital Services Act
If TaskLyft is treated as an intermediary service under the EU Digital Services Act, you can contact us at contact@elementarycreative.com. Where the law requires an EU representative, we will provide those details on request.
If we restrict content or an account, we will give a clear reason and tell you how to ask for a review, where the DSA requires it. Notices of illegal content can be sent to the same email. Using an out-of-court dispute body, where one applies, does not take away your right to go to court.
Severability and entire agreement
If a court finds part of these Terms unenforceable, that part will be adjusted only as much as needed, and the rest stays in effect.
These Terms and the Privacy Policy are the entire agreement between you and the Service Provider about your use of TaskLyft. They replace any earlier understandings on the same subject.
Changes to these terms
We may update these Terms. We will post the new version on this page with an updated effective date. Review this page from time to time. Previous versions are available on request at contact@elementarycreative.com.
